By creating an account or using the OrderPal platform, you agree to these Terms of Service. If you do not agree, do not use the platform.
These terms apply to restaurant owners and operators ("you") using OrderPal to receive orders from their customers.
OrderPal provides software that allows restaurants to accept online orders from their customers through a branded ordering page. OrderPal is a technology platform — we are not a delivery service, marketplace or food provider.
OrderPal offers two plans:
Starter — free. There is no setup fee, no monthly fee and no per-order commission on the Starter plan. Restaurants on Starter accept payment from customers directly at the counter (cash or card via their own terminal). OrderPal does not process or facilitate payment on Starter orders.
Pro — $42.90 per month (displayed as $9.90 per week), billed monthly via Stripe. The Pro plan enables online card payments processed through Stripe Connect, an insights dashboard, 30 days of order history, and removal of OrderPal branding. No setup fee. No lock-in contract. Cancel anytime.
Card processing fees charged by Stripe (currently 1.7% + 30¢ per domestic transaction) apply to online payments processed on the Pro plan. These are charged by Stripe separately and are not OrderPal fees. You may optionally pass these fees to customers at checkout — refer to Section 5 for your obligations when doing so.
OrderPal does not charge commission on individual orders under either plan.
Pro plan — online payments: All customer payments on the Pro plan are processed by Stripe via Stripe Connect. You must create and maintain a Stripe Connect account in good standing to accept online payments. Payouts from Stripe to your nominated bank account are subject to Stripe's terms and payout schedule. OrderPal is not responsible for delays in payouts caused by Stripe, your bank, or circumstances outside our control.
Starter plan — pay at counter: Starter plan restaurants collect payment directly from customers at the point of service. OrderPal does not process, hold or facilitate these payments. You are solely responsible for payment collection, reconciliation and compliance with applicable laws for counter transactions.
Pro plan — subscription billing: Your Pro subscription is billed monthly via Stripe Subscriptions. By upgrading to Pro you authorise OrderPal to charge your nominated payment method $42.90 per month until you cancel. Cancellation takes effect at the end of the current billing period.

Customer data collected through your ordering page (names, contact details, order history) belongs to you. OrderPal acts as a data processor on your behalf. We will not use your customer data for our own purposes. See our Privacy Policy for full details.
We aim to keep OrderPal reasonably available but do not guarantee uninterrupted service. We may perform maintenance that temporarily affects availability. We will try to notify you in advance of planned maintenance.
To the maximum extent permitted by Australian law, OrderPal's liability for any claim arising from your use of the platform is limited to the fees you paid to OrderPal in the 3 months preceding the claim.
OrderPal is not liable for lost revenue resulting from platform downtime, payment processing failures by Stripe, or actions taken by your customers.
OrderPal is not liable for any indirect, incidental, special or consequential loss or damage arising from your use of the platform.
Nothing in these terms excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term or condition, implied or imposed by the Australian Consumer Law that cannot be lawfully excluded.
Pro plan cancellation: You may cancel your Pro subscription at any time with no cancellation fee and no notice period. Cancellation takes effect at the end of your current monthly billing period. You will retain access to Pro features until that date. After cancellation your account automatically reverts to the Starter plan — your ordering page, menu and dashboard remain active.
Full account cancellation: You may close your OrderPal account entirely at any time. Upon full cancellation, your ordering page will be deactivated and your account data will be deleted or anonymised within 30 days, except where retention is required by law.
OrderPal may suspend or terminate your account if you breach these terms, engage in fraudulent activity, or — for Pro accounts — maintain a Stripe Connect account that is suspended or terminated by Stripe.
We may update these terms from time to time. We will notify you by email at least 14 days before significant changes take effect. Continued use of OrderPal after changes take effect constitutes acceptance.
These terms are governed by the laws of Queensland, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Queensland.
